Terms of Service

These Terms of Service ("Terms") govern your use of Duskly, operated by Leonyr LLC ("Company", "we", "us").

By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use Duskly.

2. Accounts

You are responsible for:

  • Maintaining access to your account
  • All activity under your account
  • Providing accurate information

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Use of the Service

Duskly provides AI-powered editing of real estate photography, together with disclosure and provenance-marking tools.

You agree not to:

  • Upload unlawful, harmful, or infringing content
  • Violate intellectual property rights
  • Attempt to reverse engineer or disrupt the Service
  • Use the Service for illegal purposes

Provenance marks

Every image the Service produces is marked as AI-altered, in machine-readable form and, where you select it, visibly. You must not remove, strip, obscure or defeat these marks, and you must not use the Service to produce an image that you then represent as an unaltered photograph.

Disclosure is your responsibility

The Service generates disclosure statements to help you comply with the rules that apply to you. It does not discharge your obligations. The duty to disclose an altered listing image falls on the licensee publishing it — not on Duskly. You are responsible for confirming what your jurisdiction, MLS and portal require, and for publishing the disclosure.

Where a rulebook is not publicly available, the Service says so rather than guessing. Information marked unverified must not be relied on as legal advice.

4. Uploaded Content

You retain ownership of content you upload.

By using the Service, you grant us a limited license to process your content solely to provide the Service.

Retention of originals

Retention differs from most image tools, deliberately. Where you use the Service to produce a disclosure package, the unaltered original is retained and may be published at a permanent public URL. This is a product function, not a by-product: California Business & Professions Code §10140.8 and several MLS rules require the original to remain viewable alongside the altered image, and that obligation outlives the listing.

Retention is scoped by jurisdiction. Where the law of your market requires deletion — including a valid erasure request under the UK GDPR or EU GDPR — the retention period is bound to the listing lifecycle and a defined tail rather than being permanent, and a takedown route is provided on the public page itself.

You warrant that you hold the rights to the images you upload and a lawful basis for their publication, and that occupiers have been given any information they are entitled to.

We do not use uploaded content for AI model training.

You are solely responsible for the content you upload.

5. Payments

Duskly is sold two ways, and they are billed differently:

  • Per listing — a one-time charge that unlocks the full-resolution altered images, the unaltered

originals, the disclosure text and the audit record for that listing. It is not a subscription and does not renew.

  • Agent and Studio plans — recurring monthly subscriptions, billed in advance, cancellable at any

time. Cancelling stops the next renewal; access continues to the end of the period already paid for. Listings you have already unlocked stay unlocked after a plan ends.

For both:

  • You agree to pay all applicable fees and any tax we are required to collect.
  • We may modify pricing with prior notice. A change never applies to a listing you have already

bought.

  • Failure to pay may result in suspension or termination.

Refunds

A listing purchase is fulfilled the moment it is unlocked, so fees are non-refundable except where required by law or where the Service failed to deliver the output you paid for. If a render is rejected by our own quality checks you are not charged for it. If you believe you were charged for something you did not receive, contact us and we will look at it.

6. Intellectual Property

All software, branding, design, and technology related to Duskly are owned by Leonyr LLC and protected by intellectual property laws.

You may not copy, reproduce, distribute, or modify the Service without written permission.

7. Disclaimers

The Service is provided "as is" and "as available."

We do not guarantee:

  • Error-free operation
  • Uninterrupted access
  • Specific AI outputs or results

AI-generated outputs may be imperfect or inaccurate.

8. Limitation of Liability

To the maximum extent permitted by law:

Leonyr LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages.

Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

9. Termination

We may suspend or terminate access if you violate these Terms.

You may stop using the Service at any time.

10. Governing Law

These Terms are governed by the laws of the United States and the State of [Insert State of Incorporation], without regard to conflict of law principles.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.
